Throughout the site, the terms “we”, “us” and “our” refer to Tubino Design / FXRZ s.r.o. By visiting our website, contacting us, placing an order, or purchasing a product or service from us, you agree to these Terms of Service, our Refund Policy, Privacy Policy, Shipping Policy, and any other policies displayed on our website.

If you do not agree with these Terms, please do not use our website or purchase from our store.

Tubino Design provides custom reflective DTF, holographic film, logo samples, print elements, custom transfers, and small-batch merch support for brands, creators, teams, events, and businesses.

1. Products and services

We make every effort to describe our products and services clearly and accurately.

However, product appearance may vary depending on screen settings, lighting, material, fabric colour, print size, file quality, and the chosen effect. Reflective and holographic effects are especially dependent on light, camera flash, direct light, viewing angle, and surface.

Product images are for guidance and inspiration. The final result may vary slightly, especially for custom products.

We may change, update, discontinue, or limit products or services at any time.

2. Custom and personalised orders

Many Tubino Design products are custom-made, personalised, or prepared using the customer’s logo, design, artwork, brand name, or project instructions.

This includes, but is not limited to:

- Custom logo samples
- Custom DTF transfers
- Reflective logo samples
- Holographic logo samples
- Gang sheets
- Small-batch merch projects
- Brand, team, event, or creator products made to order

By sending us a logo, design, artwork, text, or brand material, you confirm that you own it or have permission to use it for printing and production.

You are responsible for making sure your artwork does not infringe the intellectual property, trademark, copyright, privacy, or other rights of any third party.

We may refuse or cancel any custom order if we believe the submitted design is illegal, offensive, infringing, unsafe, or unsuitable for production.

3. Artwork and file quality

For custom print work, the quality of the final result depends strongly on the quality of the file provided by the customer.

The customer is responsible for sending suitable artwork, including correct spelling, logo version, dimensions, colours, and design details.

If we notice an obvious problem, we may contact you before production, but we are not responsible for errors in files approved or supplied by the customer.

4. Orders

When you place an order, you are making an offer to purchase a product or service.

Your order is accepted when we confirm it and payment has been processed. We reserve the right to refuse, cancel, or limit an order where necessary, including because of product availability, incorrect pricing, suspected fraud, unsuitable artwork, or production limitations.

Please review your order carefully before submitting it. Custom orders may not be cancellable once work has started, artwork has been prepared, or production has begun.

5. Prices and payment

Prices are shown in the currency displayed on the website.

Unless otherwise stated, prices may not include shipping, customs, import duties, taxes, or other charges that may apply depending on your location.

Prices, discounts, and offers may change at any time.

You agree to provide accurate billing, delivery, and contact information so we can process your order.

6. Shipping and delivery

Delivery times are estimates only. We are not responsible for delays caused by postal services, couriers, customs, incorrect addresses, weather, strikes, or events outside our control.

The customer is responsible for providing a correct and complete delivery address.

Shipping costs and delivery options may vary depending on the product, location, quantity, and order type.

7. Returns, refunds, and cancellations

Returns and refunds are handled according to our Refund Policy.

For standard, non-custom products, customers in the European Union generally have the right to cancel an online order within 14 days after receiving the goods, unless an exception applies.

Custom-made or personalised products made according to the customer’s specifications may not be eligible for cancellation, return, or refund simply because of a change of mind once work or production has started.

This does not affect your rights if an item is defective, damaged, incorrect, or not as ordered.

8. Intellectual property

All website content, including text, images, graphics, logos, product photography, designs, layout, branding, and visual presentation, belongs to Tubino Design / FXRZ s.r.o. or is used with permission.

You may not copy, reproduce, distribute, modify, or use our website content, branding, images, or product materials without our written permission.

When you submit your own logo, design, artwork, or brand material to us, you keep ownership of your original material. However, you grant us permission to use that material only as needed to communicate with you, prepare samples, produce your order, fulfil your purchase, and provide the requested service.

We will not claim ownership of your brand or logo.

9. Customer content, photos, and marketing

If you send us photos, reviews, feedback, testimonials, or images of finished products, we may ask for permission to use them for marketing, social media, portfolio, or website purposes.

We will not intentionally publish confidential customer designs or unreleased brand projects without permission.

10. Third-party services

Our store is hosted and powered by Shopify. Shopify provides the e-commerce platform that allows us to sell our products and services online.

Payments, shipping, analytics, email, social media, and other tools may be provided by third-party services. These services may have their own terms and privacy policies.

We are not responsible for third-party websites, platforms, or services that you access through links from our website.

11. Accuracy of information

We try to keep all website information accurate and up to date.

Occasionally, there may be errors, inaccuracies, or omissions related to product descriptions, prices, availability, delivery information, promotions, or other content.

We reserve the right to correct errors, update information, or cancel orders where information was inaccurate.

12. Prohibited use

You may not use our website or services for unlawful, harmful, abusive, fraudulent, infringing, or malicious purposes.

You may not upload or send viruses, malware, spam, false information, stolen artwork, infringing logos, or content that violates the rights of others.

We may refuse service, cancel orders, or block access where we believe these Terms have been violated.

13. Limitation of liability

Nothing in these Terms limits any consumer rights that cannot legally be excluded.

To the fullest extent permitted by law, Tubino Design / FXRZ s.r.o. is not liable for indirect, incidental, special, or consequential losses, including loss of profit, loss of revenue, loss of business opportunity, or loss of data arising from use of our website, products, or services.

For custom products, we are not responsible for issues caused by incorrect customer-supplied files, low-quality artwork, wrong measurements, incorrect order details, or customer-approved designs.

14. Privacy

Your personal information is handled according to our Privacy Policy.

Because our store is hosted by Shopify, Shopify may also process certain information necessary to operate the online store, checkout, payments, analytics, and related services.

15. Changes to these Terms

We may update these Terms of Service from time to time.

The latest version will always be available on this page. Continued use of our website after changes are posted means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the Slovak Republic, unless mandatory consumer protection laws in your country provide you with additional rights that cannot legally be excluded.
